Riverstone Highland Asphalt Paving ("we," "us," or "our") reserves the right to update or modify these terms at any time. Changes take effect when posted to the Site. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
Riverstone Highland Asphalt Paving provides asphalt paving, sealcoating, repair, and related services in Highland, California, and the surrounding Inland Empire area. The Site is used to market these services and to allow prospective customers to submit estimate requests and inquiries.
Use of the Site does not create a service agreement or obligate either party to proceed with any work. A binding service agreement exists only when both parties have signed a written contract or work order.
Estimates provided by Riverstone Highland Asphalt Paving, whether verbally, by email, or through a written quote, are based on conditions observed at the time of the site visit. Estimates are valid for 30 days from the date issued unless otherwise noted in writing.
Actual project costs may vary from an estimate if site conditions change, if the scope of work is adjusted at the customer's request, or if unforeseen conditions are discovered once work begins. We will notify you of any material changes to the price before additional work is performed.
All prices are quoted in United States dollars. We reserve the right to adjust pricing to reflect changes in material costs, fuel costs, or other market conditions between the date of estimate and the date of the job.
Scheduling is confirmed once a signed work order or written confirmation is received. We will provide a start date and communicate any changes as early as possible.
We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances outside our control. We will notify you as soon as practical and work with you to identify an alternative date.
If you need to cancel or reschedule a confirmed job, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee to cover mobilization costs. Any deposit paid may be forfeited for same-day cancellations at our discretion.
Payment terms are as stated in the written work order or contract. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept payment methods as stated on your invoice.
A deposit may be required before work begins on larger projects. Deposit amounts and conditions will be specified in the written agreement.
Invoices not paid within the time stated on the invoice are subject to a late payment fee. We reserve the right to place a mechanic's lien on the property for unpaid work, as permitted under California law.
We stand behind the quality of our workmanship. Any specific warranty terms will be stated in your written work order or contract.
The Site and its content are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
Asphalt and paving materials are subject to natural wear, weathering, and settlement over time. General deterioration due to normal use, extreme weather events, or conditions outside our control is not covered by any workmanship warranty.
To the fullest extent permitted by law, Riverstone Highland Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these terms or the services we provide shall not exceed the amount you paid us for the specific project giving rise to the claim.
All content on the Site, including text, images, logos, and graphics, is the property of Riverstone Highland Asphalt Paving or its content providers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.
We encourage you to contact us directly with any concerns before pursuing formal action. Most issues can be resolved quickly through a direct conversation.
If a dispute cannot be resolved informally, the parties agree to attempt mediation before initiating litigation. Any claim that proceeds to litigation shall be filed in the appropriate court of San Bernardino County, California.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in San Bernardino County, California.
